201st Anniversary of Borodino approaches

It's current as an anniversary, but also history, so apologies if I've started this thread in the wrong place.

7th September 2013 will be 201st anniversary of one of the bloodiest battles of the Napoleonic wars. The battle of Smolensk 1812, less than a month before resulted in about 24,000 (roughly 30%) casualties of the forces engaged http://en.wikipedia.org/wiki/Battle_of_Smolensk_(1812) , but Borodino was far bloodier, since both armies were fully engaged, resulting in about 100,000 casualties (roughly 33%) http://en.wikipedia.org/wiki/Battle_of_Borodino . It was the last major action before the capture of Moscow, and Napoleon's disasterous retreat from Russia.

I was reminded of the battle when I saw Naxzul666' video - an outstanding Napoleon Total War documentary of the battle. FWIW Naxzul666 spent some 3 months working on this, and it hit the NTW spot for me. IIRC correctly, Naxzul666 is a regular on the TWC forums, and has produced many videos there. The subtitles, and voice acting is French, but is fairly obvious I suspect for non-French speakers. Mods used are included at the end.

I've had that happen before on youtube. It's a pain. I'd try going into the youtube.com and selecting the 'world' location rather than the national specific. It seems a bizarre reason to stop you. The copyright author, i.e. Naxzul666 has used music on which copyright will have long since expired - classical, and Napoleonic marches, and such inclusion is in the scheme of things very small. I hate it when large media companies abuse intellectual property law this way. The author has deliberately but his own work in the public domain.

I tried the link again, but had no problems. Has anyone else had this problem?

FWIW, many professional musicians, especially orchestras, will claim that the rights to a particular performance are theirs even if the music is in the public domain.

Fair enough, but it's pretty pointless in this case, since it is non-commercial.

In the EU, at any rate, there are exceptions to copyright infringement where the use is within the "Fair Dealing" ambit like Research or private study, reporting current events, criticism and review. The most probable exception to which this idea applies is the exception for Broadcasts and cablecasts, specifically for free public showings, where there is NO infringement of copyright. See W.R. Cornish, Intellectual Property, 4th Edition at p438, at 11-47 re the Copyright, Designs, and Patents Act 1988. I really do wonder if some of the lawyers advising these companies actually studied IP law, or were awake during lectures. Clearly not. >:(

Anyway, there probably is approximately similar law in the US too, to protect people from companies seeking to prevent legitimate uses of material. In this case it seems they are using - if they're honest - a ridiculous argument, most probably unfounded in law. Perhaps one of the US lawyers on the forum can state the position in the US. I'd be surprised if there weren't exceptions to IP infringement of a similar nature.
