Volkswagen Emission Tests Scandal

It's been on the news all week here - sometimes I zone out - am I right in thinking in the U.S. There's no independent testing body - you guys just say to VW 'send the emission reports and we'll go over the results' - I'm sure I heard it this morning

My question is how does the modded emissions control software know that the car is at an emissions test site as opposed to racing down Rt66? Does it read date from the accelerometer chip inside the airbag so it knows when the car is in actual motion as opposed to being on the giant roller treadmill that lets the drive wheels spin in place?

I own a 2011 Jetta Diesel and never had any problems with it.  She's got 168000 miles on her and still driving strong.  At a 140HP she's got a lot of pep both off the line and at highway speeds at gets 42MPG.  If I have to mod it to meet emissions standards and the mod kills my fuel efficiency and/or power I will have a broken heart.  At that point I might as well go back to driving a gasser.
