So - cannabis is legal in Colarado.

A mate at work asked a question - How does that tie in with drug testing at the work place? If it's legal to have and consume, how can it be illegal in the workplace. I mean - I get you can't sit there smoking it - and much like alcohol, you can't sit at work drinking and must turn up for work able to perform your duties.

But you aren't tested for alcohol consumption - you can be tested for drug use and marijuana can last in your system for sometime.

Anyone from Colorado know the answer to this? Have works been told they can't sack people who are fully capable of doing their jobs even if they're tested positive for marijuana?

That said - if you work for a company that includes offices in other states, and there's a chance they could transfer you, or have you traveling to work elsewhere, then the laws get murky, and even the lawyers have admitted it'll take an actual court challenge to sort it out.

What will be really interesting is the first E3 from Ft Carson who comes in after 10 days of leave and has a piss test the next morning.

The article basically points out the double standard put in place by the law. I'm not quite sure everyone was ready for this sort of progressive legislation. Drug testing right now is sort of determined by the type of work. Workers who could endanger themselves or others while impaired seem to have a more strict testing policy (More random tests, etc.) which is good.

Most of us probably have had the same experience. You get tested when you apply for the job but not beyond that no tests unless their is some sort of probable cause.

Nope.  That E3 will be civilian Joe in short order.  That has already been addressed.

I hear y'all - but some E3 is going to become the cause celebre for a spotlight-seeking lawyer looking to change the laws.  You know it and I know it.  It's just a matter of time.  They've already played fast-and-loose with drinking ages on post vis-a-vis local laws, so the precedent is set.

Employers can and do have zero tolerance policies on drug and alcohol use. The military shouldn't be different. If you test positive, your ass is grass, as they say.

There is a zero drug use policy in place, which includes use of prescription drugs that are expired.  They aren't playing the needed numbers game anymore.

Yeah, CO state law addresses the employer question pretty clearly.  While I favor legalization of cannabis, I also favor being able to fire people who test positive for the stuff if you want to.  (there's a double-standard there, but I feel like employers ought to be able to require the same thing for alcohol and tabacco if they feel so inclined)

One big upside to the legalization of recreational marijuana in CO and WA:  You're starting to see a lot of medical marijuana companies being traded on the stock exchanges, and some of them have awesome ticker symbols!

I've never partaken of marijuana and usually don't drink in excess but maybe once a year, but I agree the rules should pertain to maui-wowie just like alcohol. Liquor ain't illegal, but showing up to work drunk/smelling like a brewery should get you fired just as fast as showing up smelling like a Grateful Dead concert and being stoned out of your gourd. That's just f&cking stupid.

If you don't have anywhere to be and you're not driving or doing anything else that'll put you or someone else in danger, fine...obliterate yourself and enjoy the consequences when you wake up (hangover, what have you). It's a small price to pay, but paying with your job, not so much.

And how many DUI accidents actually involve weed as opposed to liquor? I'd imagine many, many more are caused by the hard stuff and not the leaf.

The problem with comparing liquor with marijuana is that there are at least three categories to use: 1) those who drink only, 2) those who smoke only, and 3) those who do both at the same time.  I would be interested to read any studies that take in to account each of those three classes in several classifications: DUI, soft crime (misdemeanors and property crimes) and hard crimes (felonies like Grand Theft, rape, murder, etc.).  I would have to imagine that liquor users would be in the majority of any of those cases.  However, it is my understanding that THC (tetrahydrocannabinol, the psychoactive ingredient in marijuana) levels are being increased in many strains of pot.  How that affects those criminal statistics would interest me as well.

I guess I wasn't trying to specifically out MILF porn; just socially unacceptable things in general.

It reminded me of a time a couple of jobs ago when I had to talk to one of our customer service reps (I was a tech writer at the time) about some project, and when I walked around the corner, dude had a porn movie on. Close up view that would do a gynecological training film proud, too. He did ALT-TAB pretty damn quick when he saw me out of the corner of his eye. There were lots of women in that area - I still can't believe he had the balls to do that.

In any case, hey, porn is porn, whatever. Guns your thing? Great. Like to drink or toke up? Whatever. I'm just saying, the workplace is pretty intolerant of a lot of things; when they get uptight about Christmas decorations, it's not hard to figure out what they're going to do if they bust you with a gun, or toking out, or drinking, or watching porn, or...on and on.

+1 Pot smokers normally get mellow and boozers frequently go out of control.
