I got an email yesterday informing me that I am part of a class action suit against Netflix and if  I didn't want to participate, I had to inform the court and remove my name. WTF!?!? I checked it and its legitimate, but where do they get off making someone a part of a lawsuit without their permission? Or participation???

I emailed back demanding that my name be removed only to be informed that such a request had to be made via certified mail!!! And when you read the details of the suit, the lawyers get a minimum 25% of the settlement plus expenses and the rest goes to charity. I am infuriated to have my name associated with another craptastic, frivolous class action lawsuit that only benefits lawyers, all because Netflix retained viewing info too long, and then have them deliberately make it more difficult to have your name removed from the suit.

The part of the article I most agree with was:

like most of what's written in a EULA, it's more about what the company hopes will be law, rather than what actually is. And as ever, until such inclusions are legally challenged, no one has any idea if they're at all enforceable. Which in Valve's case will take a group starting a class action lawsuit against them.

Attempts to create rules that waive your rights, lawyers getting fat on useless and non purposeful law suits, companies phoning you after an accident to tell you you can sue company/person x

Me, too.

I have seen a couple of these as the years have rolled by. Generally speaking a check shows up that won't cover the cost of a Vente mocha cappucino at Starbucks.

In the case of Netflix I believe the stated intent was to give the money to some charity.

I didn't opt out and I didn't read it too closely. Netflix may or may not have done something wrong, but I've never seen one of these settlements yield anything worth me spending any time on, so it's easier to ignore than it is to devote a moment's thought to it.

I just don't understand why I'm automatically included in this lawyer payday.  Who do I complain to in order to prevent this nonsense in the future, anyway?

That's what makes me mad, Nefaro. It's not so much what Netflix may or may not have done, its' the sheer gall of including me in a class action suit without my consent. I don't understand how they can get away with doing so, but regardless, it's wrong no matter what the justification or legalities which allow it.
